1. General Information
These general terms and conditions govern the sale of services and experiences/activities between Expoente do Bosque UNI LDA (hereinafter referred to as "West Side Madeira") and the customer.
West Side Madeira, through its promotional channels and partners, offers a variety of tourist activities for direct or indirect customers. These activities are organized, carried out, and managed by West Side Madeira and/or qualified suppliers under agreements established between the parties.
Once an activity or product is selected (whether directly at West Side Madeira's facilities, through a partner, a website, or other means), West Side Madeira will issue proof of purchase (email, voucher, invoice, or other) after payment, granting the right to participate in the activity or use the purchased product.
2. Registration, Booking, and Reservation of Activities
2.1 General Conditions
Registering for an activity implies knowledge and acceptance of these terms and conditions.
Specific conditions take precedence over general conditions.
Activities should be booked as far in advance as possible.
Reservations can be made via phone or the official website.
A booking is only considered final after confirmation by phone, SMS, or email.
On the day of the activity, the customer must present proof of payment (voucher or other).
3. Activities
3.1 Details and Changes
Activity details and difficulty levels are available on the West Side Madeira website and can be provided verbally or upon request.
Activities are subject to weather conditions and may change without compensation.
3.2 Cancellation by West Side Madeira
West Side Madeira may cancel activities in the following cases, without compensation but with a refund minus organizational expenses:
Insufficient participants (when applicable);
Unsafe weather, water, or security conditions.
3.3 Activity Confirmation
Confirmations are usually made one or two days before the activity date.
West Side Madeira may confirm up to 12 hours before the activity due to weather instability.
3.4 Participation Restrictions
The right to participate in an activity is revoked if the customer:
Is under the influence of alcohol or drugs;
Displays aggressive, disrespectful, or dangerous behavior toward the group;
Fails to arrive at the designated time and place (10-minute tolerance);
Does not present a valid ticket/voucher/proof of purchase;
Has not completed payment, and proof of payment cannot be provided.
If a participant does not show up on the activity day without full payment, a 25% person fee will be charged.
3.5 Customer Responsibilities
Participants must follow the guides' instructions during and after the activity.
By participating, the customer accepts the inherent risks of the activity.
West Side Madeira is not responsible for damage or loss of personal belongings.
The company is not liable for accidents caused by participant negligence.
West Side Madeira cannot be held responsible for events beyond its control.
4. General Restrictions
The customer is responsible for ensuring they are in suitable health conditions for the activity. Any limitations must be communicated before purchase or booking.
4.1 Age and Physical Requirements
Minors under 18 require parental/guardian authorization.
Minimum age: 10 years | Maximum age: 74 years.
Minimum weight: 30 kg | Minimum height: 135 cm.
Maximum weight: 115 kg | Maximum height: 210 cm.
5. Refunds
Vouchers are dated and may be refunded within 15 days of purchase, subject to a 5% administrative fee.
6. Cancellations and Changes
Cancellations or changes must be made at least 24 hours in advance.
Cancellations with less than 24 hours notice result in the loss of the right to reschedule.
Failure to show up without canceling leads to loss of both the activity and the refund.
7. Weather Conditions and Unforeseen Events
A full refund or rescheduling (subject to availability) applies in cases of:
Adverse weather conditions;
Natural disasters;
Strikes;
Legal restrictions;
Transport failures.
8. Insurance
West Side Madeira holds mandatory insurance policies covering personal accidents and civil liability.
The civil liability insurance guarantees €50,000 per incident, covering damages caused by accidents occurring during the policy period, provided they are claimed within one year after the contract’s termination.
Note: Any expenses exceeding these amounts cannot be attributed to West Side Madeira. If you wish to secure additional coverage beyond the insured amounts or those not included in the contracted policy, West Side Madeira may request a specific proposal from the insurance company.
9. Vouchers
9.1 Vouchers
Once an activity or product is selected (whether directly at West Side Madeira’s facilities, through a partner, participating stores, a website, or other means), West Side Madeira will issue a voucher after payment, granting the right to participate in the selected activity or use the purchased product. This voucher must be presented on the day(s) of the activity/service.
9.2 Voucher Validity
All vouchers are valid for one year from the date of purchase, unless stated otherwise on the voucher itself.
10. Image Rights
During its activities, West Side Madeira may capture photos and videos (with sound) of the experiences. Unless the participant provides prior written notice before the activity, they grant all rights and authorize the use of collected photos and videos during, before, and after the activities. These materials may be used on the West Side Madeira website, sent to customers, and utilized in marketing and advertising campaigns by West Side Madeira or its partners. All copyright rights remain reserved by West Side Madeira.
11. Privacy
West Side Madeira ensures the confidentiality of all customer data to the best of its ability. The data subjects have the following rights:
Right to information (Article 10 of the Data Protection Law - LPD): At the time of data collection, the customer must be informed about the purpose of the data processing.
Right of access, rectification, and deletion (Article 11 of the LPD): Customers may request access to, correction of, or deletion of their data.
Right to object (Article 12 of the LPD): Customers may oppose the use of their data for marketing purposes or sharing with third parties.
